Neither PVRPV or property owners or their representatives shall under no circumstance be held responsible for any disturbance, construction noise, dust/debris or inconvenience the guest may experience while occupying the vacation property. Whether this caused by the actions of the neighboring buildings, units within the same complex, construction, renovations, mandatory repairs, public service workers or unforeseen circumstances in the surrounding area, NO refunds, reimbursements, discounts or future credits can be issued. This would also include and is not limited to the closure of condo common areas for upgrades and / or repairs. These situations are completely beyond our control and are the result of robust and growing communities.

Due to the continued and constant investment, growth, upgrades and renovations in Puerto Vallarta, from time to time there may be a minor interruption of public services including hydro, water or sewer or the lack thereof. Although this is not a common problem in PV, it can happen.

Property Policy


- ALL properties represented by PVRPV are NON SMOKING this includes; patios, terraces, outdoor spaces attached to or a part of a Vacation Rental Property - if smoking takes place inside the property – you will be obligated to pay, a fine, an extra cleaning fee and you may be evicted.

- Clients shall not remove any item/s from the property, such as kitchen appliances, glassware, furniture, or any other item.

- The use and enjoyment of the property does not include illegal activities such as the use of illegal drugs, prostitution, selling of goods (illegal or otherwise) and/or kidnapping, this is strictly prohibited.

- Excessive noise that may affect neighbors will be strictly sanctioned as per the local building rules and regulations established by the property that you are occupying.

- PVRPV guests and/or the visitors of the guest(s) are responsible to adhere to the rules, regulations and polices of PVRPV and/or the individual property policies thereof. Failure to obey the rules and policies established will be asked to vacate the property without the right to any refund.

The responsibility to know or adhere to the policies, rules or regulations are the responsibility of the guest.

These are rules based in the Regulations of the V177 Condominiums,which is grounded in the public deed that contains the constitution of the Regime of property in the condominium and the formalization of the regulations, plans and other documents, which is intended to complement and specify with more detail the rules that will allow owners a better and comfortable living. These rules do not cover all the regulations contained in the V177 regime nor can they be considered as a replacement of the regime. The location of the property, its size, boundaries, general description of the condominium, of each of the buildings, especially each of its parts, the description of each department, the common parts of the condominium, the property value, of each department and the percentage that corresponds to each owner is included in the deed of each condominium.
CONTENT
1 .- THE RIGHTS AND OBLIGATIONS OF OWNERS
Each owner can use his condominium and disposed of it, with the limitations and prohibitions set forth in this Regulation and in accordance with the provisions of Article 1010 Civil Code of the State of Jalisco.
1.1 .- The owner is entitled to make use of their apartment and dispose of it, the apartment can be transferred or leased, without the consent of the other joint owners and to exercise all acts of ownership of their property, but owners are not allowed to sell or sublet separate parts of the apartment, such as bedrooms, equally owners must respect other restrictions and prohibitions that the Law, the Constitutional Deed and these Regulations impose.
1.2 .- The owner must fulfill the obligations before the other owners and in future meetings. In any case the owner has the obligation to notify and receive approval from the present administration in the events of:
a) .- Performing any building works, for example, modifications within the unit, that could affect the structure, walls or other essential elements of the construction that may impair its stability, security or comfort.
b) .- Performing works that may alter the urban and / or architectural image, which violates the established by the Law, the Constitutive Deed and this Regulations.
c) .- Possessing animals that may affect the stability, safety, sanitation or comfort of the condominiums caused by the number, size or nature of the animal unless a special permission is given by the General Assembly.
d) .- If installing security doors, windows, patio fans, or any other feature that is visible from outside your unit, you must first contact the administrator for a list of approved designs, models, and colors.
1.3 .- Any owner, resident or visitor of the "V177" Condominiums, must obey the "V177" Condominiums Regulations and its additional clauses.
1.4 .- The guest access to facilities will be controlled by the Condominium administration through a guestbook in which a record is kept of the persons entering whenever it is necessary, in order to maintain control of the facilities including the pool and Jacuzzi.
1.5 .- If a guest asks to enter the condominium to which he was invited without having key or keycard and the owner is not reachable, he will be denied access to the building. Under no circumstances will we authorize access to a locksmith if the owner is not present.
1.6 .- All owners should monitor and take responsibility over any deterioration caused by their guests within an apartment or in any of the common areas. Common area damage will be repaired by the administration and costs will be charged to owner.
1.7 .- The administration will not carry out any kind of intermediation between the owners and guests. Any complaints about the apartment must be told directly to the owner that authorized the stay.
1.8 .- No host or guest is authorized to intervene in the operation of the building. It is stated in the Regulations that only at annual meetings decisions will be taken to implement or modify any clause of the Regulations, while clauses of the Rules document can be modified by Administration as needed.
1.9 .- The owner must sign the visitor logbook to record each time you invite a visitor to use the facilities. Visitors can not do it by themselves.
1.10 .- When you have guests, lend or lease your apartment, the owner is obliged to register the guest with Administration including the details of the occupant such as: kinship, number of people living in the apartment, period of stay, type of car, etc..
1.11 .- Owners and guests may not ask to the security personnel or maintenance for personal favors within their work schedule, as this could affect your and their relationship with the administration.
1.12 .- Administration is not responsible or liable for any damage or theft of any personal property.
1.13.- Studio units may not be occupied by more than 2 adult persons. One-bedroom units may not be occupied by more than 4 adult persons. Two-bedroom units may not be occupied by more than 6 adult persons.
2 .- PAYMENT OF MAINTENANCE FEES
2.1 .- From the time of having the unit delivered (signing the sales contract of any condominium,) there is a stated percentage to be paid (currently 3.30 USD per M2) for the monthly maintenance fee that is determined in relation to the measures (area) of the apartment acquired. This data is stipulated in the deed of the unit.
2.2 .- The amount of the common costs is determined by each community of condominiums and the Administration, considering the actual expenses for any type of services without a maximum or minimum being established by the Law.
2.3 .- Based on our previous experience we will calculate the approximate expenses made by year, to set a provisional budget. Once the term of the provisional budget expires, the Administration must submit a report with all the actual expenses and on that basis determine whether the budget actually served to finance the common expenses. If a credit balance exists, that amount will be credited for the next budget, but if the fee was not enough to cover the actual expenses, the following budget will be calculated assuming a percentage dedicated to pay the debt of the previous period.
2.4 .- Each owner must pay the maintenance fee on the first business day of each month. An account will be considered in arrears if not paid by the tenth day of the month. If an account is in arrears, there will be a late fee of 5% on the unpaid balance. If an account is in arrears of six months or more, the owner will lose access to common services (water, gas, common areas, etc) until the account is made current. If an account is in arrears of one year or more, administration will seek legal remedy. The owner may not lease their unit while their account is in arrears.
2.5 .- The fact that an owner does not make effective the use of a service, or does not make use of common areas, does NOT exempt the owner from the obligation to pay in full the monthly maintenance fee.
2.6 .- The payment of maintenance fees will begin when a unit is delivered to the owner or as soon as the owner starts making use of the services that the Condominium and the Administration are offering, whichever is first, independently if it was stated in the deed or not. Upon delivery, the owner will pay a reserve equal to three months of maintenance fees, plus the first month’s prorated amount of maintenance fee.
2.7 .- Each owner is obligated to notify the Administration of their leases. The owner has the obligation to inform the new tenant of the rules and regulations. The owner remains responsible for payment of the maintenance fee during the term of lease. The owner must inform the new tenant, that the owner is responsible in case of damage of any kind, as it is stated in the preceding paragraphs and clauses. The new tenant must check in with administration upon arrival to leave a copy of identification and to sign a copy of the rules document. Owners are responsible for payment of any fines incurred by their tenants.
2.8 .- Administration retains the right to evict tenants that are not complying with the terms of the Rules and Regulations.
2.9 .- The owner must also pay their property taxes as well as the electricity (CFE) service fees and any other expenses that correspond to the property.
2.10 .- Owner must not sell their units until fulfilling all the obligations to the Condominium such as outstanding debts, provided that the new owner shall be fully responsible for paying for them anyway. As stipulated by law, no notary will approve if there is any debt.
3 .- PROHIBITIONS Actions affecting the peace, welfare and safety of the condominium are not allowed including acts or attitudes contrary to law, order and good morals. As such, owners, residents and visitors are prohibited the following:
3.1 .- PROHIBITED inside the condo:
a) Violating the laws of the rules and regulations and therefore the criminal code the state of Jalisco, at the risk of being denounced to the authorities by the administration.
b) Making use of a unit as a not private office, clinic, school, classroom, academy, guest-house of 3 or more persons for long periods or charge for accommodation, gym, dance hall or manufacturing workshop.
c) To sublet, to house or to call persons exercising any form of prostitution in its various forms including meetings and parties, or with any intent of pornography, situations, all at risk of being considered a crime with the aggravation of penalty, if the actors are children.
d) Selling or consuming drugs, pornography, piracy, making scandals, armed persons meetings, etc.
e) Using sound devices, TVs, or videos with excessive volume, especially after 10:00 PM and/or before 8:00AM.
f) Displaying signage of any kind in windows or doors, including political, religious, for rent/sale, etc.
g) Using colorful outward facing curtains, as all exterior facing curtains must be a beige or neutral color, matching closely with the color of the building.
h) Hanging clothing or materials of any kind from railings, windows, balconies, etc.
i) Using high-heeled shoes or shoes that cause knock on the floor and disturb the residents of lower floors.
j) Having parties or meetings after 10:00 PM, as events must be scheduled with administration and parties will be conditioned on the weekend, always avoiding the scandal, the presence of groups or live bands, and excesses in general.
k) Any indecent or sexual act, visible to neighbors through open windows.
l) Laughing, crying or talking outrageously or using offensive language.
m) Using service equipments such as, washers, dryers, etc after 10:00 PM and/or before 8:00AM.
n) Leaving on, stereos, air conditioning, lights or fans when not in the apartment.
o) Refurbishment works to alter the exterior walls, doors and windows of the condominium, as any construction work will require permission from the administration.
3.2 .- PROHIBITED in the outer areas, terraces, corridors, elevators, bathrooms, pools and garden area:
a) Any form of nudity, exhibitionism and attitudes involving erotic acts as the offender will be reported to the authorities immediately.
b) Selling or consuming drugs and drinking alcohol to excess.
c) Smoking is not permitted in the common areas. Smoking is permitted inside the private units, on private balconies, and outside the building.
d) Organizing parties that involve scandal with sound equipment, loud live bands. All parties will require authorization by the Administration, upon agreement of the other condominiums.
e) Disobeying the schedule of common areas of 8:00 AM to 10:00 PM Monday through Thursday and 8:00 AM to 12:00 midnight Friday through Sunday.
f) The presence of guests without the owner or without the owner taking responsibility of his apartment, behavior within the apartment, cleanliness and order of the place.
g) Using the terraces of the condominiums as bedrooms or warehouse or placing anything on the terraces that detracts from the buildings aesthetics or obstructs the passage.
h) Standing or sitting on the walls, railings or planters.
i) Laughing, crying or talking outrageously or with offensive language.
j) The use of stereos, TV or phone with loud music or voice.
k) Using balls or soccer balls by adults or older children.
l) Talking loudly on a mobile telephone after 10:00PM and before 8:00AM.
m) In the case of pets allowed, the owner will take care of animal�s behavior and collect their waste, the administration warned that if three or more owners complain of a pet in writing within a 30 day period, it will have to leave the condominiums. Pets are not allowed at any time on level 7.
n) Removing bunks, mattresses, chairs and tables from their place and not return them to its original position.
4. - REGULATION OF SPECIFIC AREAS:
4.1 .- THE POOL AND JACUZZI They are common property of all owners so we recommend the utmost discretion in the type and number of persons to be invited by the owner, so that any user is commensurate with the level and type of The V177 Condominiums. Each owner is entitled to have guests, but also has the obligation to consider the rights of other owners in actions that could cause their discomfort.
4.1.1 .- PROHIBITED in the pool or jacuzzi:
a) Continuously have external guests, not being present when they use the site, accepting strangers among the guests as well as inviting more than 6 people, -except for an event scheduled and approved by the administration. Under no circumstances, we will accept any person that comes without an invitation to use the pool or jacuzzi.
b) Being in or out of the water naked, topless or in any costume that involves sexual exhibitionism.
c) Entering the water with clothes, shorts or shirts, everyone is obligated to wear a bathing suit.
d) Making use of the facilities after the permitted hours 8:00 am to 10 pm Monday through Thursday and 8:00 am to 12 midnight Friday through Sunday.
e) Taking foods or drinks into the water.
f) Using of objects of glass in the water. Use plastic only.
g) Leaving floating objects or toys in the water.
4.1.2 .- REQUIREMENTS for using the pool or jacuzzi:
a) Every owner must keep in mind that they are directly responsible for the conduct of guests and that they respect that the V177 Condominium is a family residence and not a resort.
b) That for their own safety, avoid walking through the halls, bathrooms or use other facilities and elevators, while being wet. All users of the pool should be dry when they leave.
c) For proper hygiene, use the shower on the terrace, before entering the pool.
4.1.3 .- JACUZZI specific requirements:
a) The jacuzzi is exclusive to the Condominiums. If an owner is having guests, relatives or friends, owners must inform the administration in advance so that we approve the use by outside persons. Under no circumstances will we allow any unregistered guest to go directly to the Jacuzzi.
b) The maximum stay per person - owner and guests, is 6 people and will be restricted from 45 to 60 minutes, when there is a request by another owner to use the jacuzzi. Otherwise, stay may be extended until someone else requests it.
c) Under no circumstances may another person enter the Jacuzzi when it is occupied in advance, unless the user in turn permits it.
d) The person who is responsible for operating the ignition of the bubble and heating will be responsible for shutting it down.
4.2 Rooftop Common area
a) Children under 12 must be supervised by an adult at all times.
b) The BBQ must be reserved with administration. All parties and gatherings in common areas must be approved by administration. Gatherings of more than 7 people require approval from the administrative council.
4.3 Gym
a) Children under 12 must be supervised by an adult at all times.
b) The gym may be used between the hours of 7 AM and 10 PM every day of the week.
4.4 .- PARKING
a) No visitor will have access to parking lots.
b) Owners and occupants are prohibited from parking in parking spaces assigned to other units.
c) It is not permitted to leave or store vehicle parts such as tires, wheels, car accessories, etc in the parking lot, or to throw garbage out of a car in the parking lot.
d) No parked vehicle is allowed to occupy 2 spaces or extend beyond their assigned parking space by more than 30 cm (1 foot). Vehicles may not cover or obstruct circulation areas.
e) It is not permitted to park vehicles in a bad state in the garage that affect the image of the area, stain the floor, or pollute.
f) It is not permitted to use the horn or sound equipment with high volume in the parking area.
g) All vehicles parked in the garage must be in an operable condition and all abandoned vehicles will be towed at the owner�s expense.
h) Owners are prohibited from renting parking spaces to any nonresident.
5. - DISPUTES AND PENALTIES
5.1. - Any controversies that may arise from the interpretation and application of the Rules and Regulations, Constitutive Deed of the General Assembly resolutions and other applicable laws, shall be settled by court defendant and in front of a examining magistrate.
5.2 .- Violations of the clauses in the Rules or Regulations shall be punished according to what has been stated in the General Assembly of the Condominiums and fines may be imposed and enforced by administration.
5.3 .- Any complaints or reports of irregularities and / or violations of the Rules or Regulations reported to administration will be analyzed according to the magnitude and seriousness of the case. The responsible person of the offense will be summoned to present any clarifications.
5.4 .- Violations of these rules will result in sanctions as defined by the general assembly of owners. As you can see, the ultimate goal of these rules is to appeal to the common sense of each and every one of those who reside here, so that together we can achieve a healthy and respectful coexistence that gives us the satisfaction of making good on our investment in the V177 Condominiums.


ADDITIONAL FEE FOR CLIENTS ARRIVING BEFORE AND AFTER REGULAR WORKING HOURS

Please be advised that if you are driving or flying to Puerto Vallarta, you must ensure that you plan your travels well and expect to arrive at the rented property no later than 8 PM. on any given day. Clients who arrive after 8 p.m., will incur an additional charge of $25.00 USD I.V.A Included which must be paid in cash. This will be collected upon check in. In addition, there is no check in time before 8 a.m. on any given day, otherwise, the same additional fee of $25.00 USD cash applies. Most of the properties allow a check in time of 3 p.m.

You should please remind the house keeping staff to make the bed with the bed pillows - the decorative ones were all that were put on the bed. The unit, PVRPV, and building were amazing
